New Video: Virginia Law & Business Review Symposium on Antitrust and Innovation in the Digital Age

Earlier this month, I had the pleasure of being a panelist at the Virginia Law & Business Review’s symposium on Antitrust and Innovation in the Digital Age at the University of Virginia School of Law. The specific panel I was on discussed the forthcoming merger guidelines that the Department of Justice and Federal Trade Commission announced they were revising in January 2022.
My commentary boils down to the following. The highly favorable merger cases the Supreme Court decided in the 1960s are still controlling law. Despite the wishes of many, those cases have never been overturned. They might be overturned in the future. But they have not been. As such, I argue that they should be rigorously adhered to. I also discuss how restricting mergers can benefit the public.
My co-panelists were William (Bill) Kovacic, former Chairperson of the Federal Trade Commission and current professor at George Washington University Law School, and Dr. Nathan Wilson, Executive Vice President of Compass Lexecon. Our discussion was exceptionally cordial, so do not expect any fireworks.
